Best Western Hotel is facing a wrongful death suit after a couple lost their lives while vacationing at the hotel. The lawsuit references recurring equipment issues and instances of human failure as primary causes of the deaths.
The couple was staying in a room in the hotel that was situated directly above the equipment room that powers the hotel’s indoor pool. Carbon monoxide leaked up from the equipment room into the hotel room and ultimately caused the deaths.
This isn’t the only incident in this particular room at the Best Western location in question. Approximately a month after this incident another guest of the hotel was killed from carbon monoxide poisoning and one more was seriously injured. In response to the incidents Best Western has installed carbon monoxide detectors in the rooms of all of their hotels, but the family who filed the lawsuit believe that these measures should have been taken long ago.
Had the detectors been in place in the rooms there is a chance that only minor injuries would have occurred and that emergency personnel would have been alerted to address the issues in the equipment room. This will likely be a heavy focus for the legal team of the plaintiffs and could be key in swaying the jury to decide in favor of the guests of the large hotel chain. If the jury finds Best Western liable, the hotel chain could be faced with a substantial settlement and subsequent lawsuits.
Hotels and resorts have an obligation to keep visitors and guests safe during their stay. If you feel as though a business failed to provide a safe environment or you sustained injuries as a result of equipment failure or negligence while on someone else’s property, you should reach out to a lawyer as soon as possible. An experienced personal injury attorney will be able to identify if a business or individual is responsible for your injuries and take action to get you any damages you might be entitled to.
