California based tech giant Oracle is the latest company to come under fire for negatively effecting competition and participating in activities designed to suppress salaries.  Oracle is now being sued for entering into an agreement to not hire away employees from other tech powerhouses in an effort to keep salaries at the lowest possible level.

Greg Garrison, who spent time with Oracle in 2008 and 2009, has officially filed a lawsuit against his former employer claiming that these hiring (or non-hiring) practices hurt not only individual employees by preventing them from receiving competitive salaries, but hurt the industry as a whole.  Garrison is reportedly seeking class certification in order to prevent these types of agreements from effecting employees and the future in addition to compensation for damages.

This isn’t the first time tech companies have been called out and punished for eliminating competition for employees to keep salaries down.  In 2010 tech giants like Google, Pixar, Apple and Adobe settled a very similar lawsuit which totaled hundreds of millions of dollars and a promise to not enter into any agreements that would stifle the competition for top employees.

As this is seems to be becoming an all too familiar scene for major tech companies in California, Oracle stands to get much more than a slap on the wrist – especially if Garrison’s attorneys have their facts together.  If there are enough facts available to show that Oracle had prevented their former employee from securing employment with another force in the industry, Garrison could walk away with a nice settlement.  If successful this could also pave the way for additional lawsuits against Oracle and any other tech company who was involved in the agreement not to poach.
