Yacht painter James Grupinski is suing his former employer and the CEO of tech giant Google after being forced to work in unsafe conditions. The painter has since been treated for a number of health conditions after working 12 hours per day for several days in a row with toxic chemicals in a poorly ventilated environment.
The painter claims that he lost consciousness and bled from his eyes and ears after working in the unsafe conditions. He also states that he was denied requests to seek medical treatment and told to get back to work after hours of exposure to a paint thinner that was pulled from the market more than a decade ago.
In addition to the immediate damage sustained as a result of the unsafe conditions, Grupinski claims that he is now suffering from a multitude of health problems that stem from the incident including seizures, COPD, early onset Alzheimer’s disease and more. Grupinksi is seeking unspecified damages related to medical costs, personal injury and ongoing care.
If the yacht painter’s claims are accurate, this case goes beyond what is typically classified as unsafe working conditions to a point of gross negligence (or possibly worse) on the part of his employer. If his legal team can prove his claims his former employer could be forced to pay a hefty settlement for their involvement.
Employers are required to provide a safe working environment for their employees. IF you feel as though there is an unnecessary risk of injury in your workplace or if your employer puts you or others at risk in any way you should reach out to a lawyer immediately. An experienced attorney can evaluate your working conditions to determine if there is evidence of a violation. If your company is in the wrong your attorney can institute the steps necessary to ensure a safe environment and fight to get you any damages you might be entitled to.
