toyotaA jury ruled that Toyota was at least partially responsible for a 2006 accident that killed three people and injured two others.  While the 1996 model Camry had not been one of the vehicles recalled for issues, jurors have held the auto manufacturer 60% responsible for the wreck and awarded more than eleven million dollars to plaintiffs and their families.

The jury in the original trial held the driver of the vehicle responsible for the accident and he spent more than two years behind bars for vehicular manslaughter for his role in the unfortunately event.  The driver maintained his innocence throughout the trial and his incarceration, claiming that he depressed the brake in an effort to slow down but that the assembly was defective and the vehicle continued to travel at a high rate of speed despite his efforts to slow it down.

This was undoubtedly a difficult case for the jury to decide.  No one knows exactly how the driver reacted in the stressful situation while behind the wheel or if there could have been a defect in a model and year that otherwise seemed to have been safe, despite more recent issues that led to recalls.

Car manufacturers and drivers both have obligations when it comes to keeping the roadways safe.  If you have been injured in an accident that was caused by another driver’s negligence or a manufacturer defect you need to reach out to a lawyer as soon as possible.  An experienced personal injury attorney can evaluate all of the vehicles involved in the accident to determine negligence on the part of the auto manufacturer as well as the details of the accident itself.  This can pinpoint who, if anyone, is at fault and help to secure any damages for those who were injured as a result of the accident.
